		<description>I have been seeing a great deal of news about the fraud going on within the Foreclosure Mill Attorneys offices these days.  I have in the past dome some investigative work related to foreclosure and have personally seen a great deal of abuse related to the Affidavit of Diligence.  In some instances the attorney’s did not want to have to serve anyone and requested that the Affidavit be done immediately so they could go to publication.  In other instances I have seen people who have no idea of what they are doing prepare the document and swear to it.  I have just recently seen some attorneys begin to challenge the affidavit and I can tell you that anyone who has not been personally served with court documents and have later found that they failed to respond to the publication should get a copy of this affidavit and go over it completely.
The problem is that most people don’t understand how an investigation to find someone works.  There are many “Data Providers” that will sell a product with the false representation that you can find anyone.  Different data sources product different results and if you do not understand how the system works you will in some instances be giving false information based upon the findings.  Looking on the web, running a search on a data base or making a few calls is not a diligent search.  I can change my own oil in my car but I am not a mechanic.  I can stop the bleeding of a small cut but I am not a medical professional.  Why would you think that you can do a competent and diligent investigation?  
Don’t get me wrong.  I have no pity for someone who bought a house they could not afford and now don’t want to pay for it.  I also have no love for banks who allowed this to take place and now won’t work with a person to keep their house.  I do believe that the law is the law and it should be followed correctly without cutting corners.</description>
